What is hearing representation?

Hearing representation is an important part of everyday legal practice. It refers to one attorney representing another attorney in court when the originally appointed attorney cannot attend in person due to scheduling conflicts, personal unavailability, or other reasons.

Purpose of hearing representation

As a rule, one attorney is represented by another to ensure that a court hearing does not have to be cancelled or postponed. Courts rely on efficient case management and expect all hearings to be attended. Hearing representation ensures that the client is still adequately represented even if the originally instructed attorney is unable to attend.

Requirements and procedure

The arrangement of hearing representation is usually made between the attorneys involved and does not necessarily have to be coordinated with the client, as it is an organisational measure. However, the client is informed about the representation and may consent to it.

As a rule, the attorney taking over the representation must familiarise themselves thoroughly with the case in order to appear competently in court. This includes reviewing the files as well as understanding the legal issues to be decided in the proceedings. In many cases, the representing attorney will coordinate in advance with the attorney being represented to ensure that the client’s legal strategy is maintained.

The process of hearing representation

  1. Agreement on representation: The attorney taking over the representation is instructed by the attorney who is unable to attend or directly by the client. They are usually granted detailed access to the case files and informed of the key points of the proceedings.
  2. Court representation: The representing attorney attends the court hearing and conducts the hearing in the client’s interests. In doing so, they ensure that the client’s legal interests remain protected.
  3. Feedback to the client: After the hearing, the client is informed about the course of the hearing and the decisions made. The attorney who took over the representation is obliged to inform the client about the next steps.
