The Regional Court of Ellwangen has convicted the mayor of Niederstetten of forgery of documents involving abuse of office, sentencing her to a fine. The criminal chamber followed the prosecution’s motion; the verdict is not yet final.
The focus of the evidence hearing was the testimony of a former head of administration, whose statements, in the court’s view, contributed significantly to clarifying the facts. The witness faced accusations herself beforehand and retained legal counsel as well as witness counsel to protect her legal interests.
Attorney Mathias Brenner accompanied the witness in the proceedings as witness counsel and assisted her in presenting her testimony in a structured and legally sound manner before the court. The court assessed the testimony as credible and decisive for its decision.
The chamber considered several mitigating factors, including the defendant’s confession, the passage of time since the offense, and the considerable public attention. An appeal to the Federal Court of Justice remains possible.
