Unlike other offences, it regulates various gradations of an attack on <\/span><b>sexual self-determination<\/b><span style=\"font-weight: 400;\">. The <\/span><b>basic offence<\/b><span style=\"font-weight: 400;\"> is sexual assault.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-4e903d5 e-flex e-con-boxed e-con e-parent\" data-id=\"4e903d5\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-051376d elementor-widget elementor-widget-text-editor\" data-id=\"051376d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Section 177(1) StGB defines sexual assault as follows: <\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">&#8220;Anyone who, against the discernible will of another person, performs sexual acts on that person or has them performed by that person, or causes that person to perform or tolerate sexual acts on or by a third party, shall be punished (&#8230;)&#8221;.<\/span><\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d28a34d elementor-widget elementor-widget-text-editor\" data-id=\"d28a34d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p> <\/p>\n<p><span style=\"font-weight: 400;\">The following <\/span><b>4 requirements<\/b><span style=\"font-weight: 400;\"> must be met for sexual assault:<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A sexual act,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">that is carried out against the will of the other person,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the opposing will must be discernible, and<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">intentional conduct by the accused person<br><br><\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">Essential in all sexual offences\u2014and most often a problem when it comes to proving the case\u2014is the <\/span><b>discernible opposing will<\/b><span style=\"font-weight: 400;\"> of the other person. This can be expressed by saying &#8220;No&#8221;, but also by clearly recognizable defensive behavior, gestures, or facial expressions. What matters is whether this opposing will was <\/span><b>discernible<\/b><span style=\"font-weight: 400;\"> to the accused. In practice, this is extremely difficult to prove and therefore offers good <\/span><b>defense options<\/b><span style=\"font-weight: 400;\"> for an experienced criminal defense lawyer.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The same penalty also applies if the sexual assault is committed by <\/span><b>exploiting a particular situation<\/b><span style=\"font-weight: 400;\">\u2014for example, if the other person is not able to form or express their opposing will. If additional elements are present, such as the use of threats or violence, it may constitute <\/span><b>sexual coercion<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Rape involves a sexual assault that is associated with <\/span><b>penetration of the body<\/b><span style=\"font-weight: 400;\"> of the other person or another form of <\/span><b>particular humiliation<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-cc457bf e-flex e-con-boxed e-con e-parent\" data-id=\"cc457bf\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-9914b8f elementor-widget elementor-widget-text-editor\" data-id=\"9914b8f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Section 177(6) StGB states: <\/span><\/p>\n<p><i><span style=\"font-weight: 400;\">&#8220;A particularly serious case shall generally be deemed to exist if the offender has sexual intercourse with the victim or causes it to be performed, or performs or causes to be performed on the victim similar sexual acts that particularly humiliate the victim, especially if they involve penetration of the body (rape).&#8221;<\/span><\/i><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-c4c4d9c elementor-widget elementor-widget-text-editor\" data-id=\"c4c4d9c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\"><br>Accordingly, there must be a sexual assault associated with sexual intercourse or an act similar to sexual intercourse. <\/span><b>Acts similar to sexual intercourse<\/b><span style=\"font-weight: 400;\"> include self-penetration, oral and anal intercourse, penetration with body parts or objects, and ejaculation by the accused into the victim\u2019s mouth without penetration.<br><br><\/span><\/p>\n<h2><b>Allegation of rape: When does penetration of the body occur?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Sexual intercourse is understood to mean intercourse, i.e., the act in which the male organ penetrates the vagina. According to case law, this is already fulfilled if the male organ reaches or touches the female vaginal vestibule. However, the offence of rape is broader than mere intercourse due to the addition of &#8220;penetration of the body&#8221;.  <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Both <\/span><b>anal intercourse<\/b><span style=\"font-weight: 400;\"> and <\/span><b>oral intercourse<\/b><span style=\"font-weight: 400;\"> count as penetration of the body. In addition to penetration with a sexual organ, penetration with other<\/span><b> objects <\/b><span style=\"font-weight: 400;\">or<\/span><b> body parts<\/b><span style=\"font-weight: 400;\"> (for example, a finger) is also sufficient to meet the elements of the offence. How far penetration into the victim\u2019s body must go is to be decided on a case-by-case basis.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition, <\/span><b>particular<\/b> <b>degradation<\/b><span style=\"font-weight: 400;\"> during the act is also considered rape. For this, the accused must degrade the other person in a particular way to a (sex) object and express this through the manner of the sexual act.<br><br><\/span><\/p>\n<h2><b>Penalty range: What sentence can be expected for rape?<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">As a particularly serious case of sexual assault, rape carries a prison sentence of <\/span><b>at least 2 years<\/b><span style=\"font-weight: 400;\"> upon conviction. There is no upper limit, meaning prison sentences of <\/span><b>up to 15 years<\/b><span style=\"font-weight: 400;\"> are possible.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">If the accused carries a weapon or a dangerous tool during the offence, they face <\/span><b>at least 3 years\u2019 imprisonment<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The minimum sentence is even higher if<\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the weapon or dangerous tool is actually <\/span><b>used<\/b><span style=\"font-weight: 400;\">,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the victim is <\/span><b>seriously abused<\/b><span style=\"font-weight: 400;\"> during the offence, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the victim is placed in <\/span><b>mortal danger<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> <\/span><\/span>\n<p> <\/p>\n<\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">In that case, <\/span><b>at least 5 years\u2019 imprisonment<\/b><span style=\"font-weight: 400;\"> is \u043f\u0440\u0435\u0434\u0443\u0441\u043c\u043e\u0442\u0440\u0435\u043d\u043e. If the victim dies as a result of the offence, the prison sentence is <\/span><b>at least 10 years<\/b><span style=\"font-weight: 400;\">, and life imprisonment is also possible (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__178.html\"><span style=\"font-weight: 400;\">Section 178 StGB<\/span><\/a><span style=\"font-weight: 400;\">).<\/span><\/p>\n<p><span style=\"font-weight: 400;\">In addition to criminal-law consequences, victims of rape may also assert civil-law claims, in particular <\/span><b>compensation for pain and suffering<\/b><span style=\"font-weight: 400;\">. Even if another court has jurisdiction, such a claim can also form part of the criminal proceedings.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">The accused should be aware that, in addition to legal consequences, an allegation of rape can also have <\/span><b>significant repercussions for the social environment<\/b><span style=\"font-weight: 400;\">, career, and overall reputation.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-86bbd1e e-flex e-con-boxed e-con e-parent\" data-id=\"86bbd1e\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-eeb25db elementor-widget elementor-widget-text-editor\" data-id=\"eeb25db\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">It is therefore important to handle an investigation for rape as <\/span><b>discreetly<\/b><span style=\"font-weight: 400;\"> as possible and to seek an <\/span><b>early discontinuation<\/b><span style=\"font-weight: 400;\">. Especially if the alleged <\/span><b>act took place<\/b> <b>at the workplace<\/b><span style=\"font-weight: 400;\">, even suspicion can have employment-law consequences, such as dismissal or disciplinary proceedings.<\/span><\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0a57b9e elementor-widget__width-initial elementor-widget elementor-widget-text-editor\" data-id=\"0a57b9e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h2><b><br>Police summons: Tips from a lawyer specializing in sexual criminal law<\/b><\/h2>\n<p><span style=\"font-weight: 400;\">Often, the accused only learn of the allegation against them when an <\/span><b>arrest warrant<\/b><span style=\"font-weight: 400;\"> is applied for. If the rape is alleged to have taken place recently in an apartment, the police will generally attempt to find possible traces by means of a <\/span><b>house search<\/b><span style=\"font-weight: 400;\"> (e.g., semen, blood, DNA). <\/span> <\/p>\n<p><span style=\"font-weight: 400;\">The initial shock of such a situation is usually followed by helplessness and panic. The question remains as to how to handle this unexpected confrontation. <\/span><\/p>\n<p><span style=\"font-weight: 400;\">Below, we present a few rules of conduct for such a case. However, this does not replace individual legal advice under any circumstances. For a non-binding initial consultation, please contact us directly.  <\/span><\/p>\n<p><b>How to behave when summoned by the police:<\/b><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Always take the allegation seriously: <\/b><span style=\"font-weight: 400;\">If you believe the allegation is fabricated, you may get the impression that everything will blow over and the officers will find out themselves that there is nothing true to the alleged victim\u2019s accusation. However, especially in sexual offences, there is usually <\/span><b>little to no evidence <\/b><span style=\"font-weight: 400;\">and only two witnesses: the alleged perpetrator and the alleged victim. It is therefore more than <\/span><b>unclear<\/b><span style=\"font-weight: 400;\"> how such proceedings will end. Doing nothing only increases the risk of an expensive and arduous court trial. <\/span><b>Do not waste valuable time<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> and contact a specialized lawyer as soon as possible.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Do not appear for a summons:<\/b><span style=\"font-weight: 400;\"> Excessive eagerness is also out of place in such a situation. It is understandable that you want to explain yourself to the police, present your perspective, and thus refute the allegation against you or eliminate it entirely. However, great <\/span><b>caution<\/b><span style=\"font-weight: 400;\"> is required. With a summons, you can quickly<\/span><b> incriminate yourself <\/b><span style=\"font-weight: 400;\">and thus contribute to your<\/span><b> own conviction<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">. You should therefore not appear at the police at all, as you are not obliged to do so. Instead, contact a lawyer who will advise you comprehensively, request access to the files, and cancel the appointment on your behalf.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Do not make a statement<\/b><span style=\"font-weight: 400;\">: If you are already at the police station or have been provisionally arrested, make use of your <\/span><b>right to remain silent<\/b><span style=\"font-weight: 400;\"> in any case. It is your right to remain silent. Instead, request to contact a <\/span><b>lawyer<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">. You have this right at any time, including during the investigation.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Searches<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">: In some cases, searches may also occur. Always remain cooperative, ask to see the warrant, and under no circumstances actively assist with the search. Do not voluntarily disclose passwords or access data. Instead, contact a criminal defense lawyer.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Do not contact the alleged victim:<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\"> The accused are often angry that they are being accused of such an act. The urge to call the alleged victim or put them under pressure is strong. Nevertheless, you should refrain from contacting the complainant. This is how you can behave in the event of (attempted) rape: <\/span><\/p>\n<ol>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Make your will clear<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">: This is not always possible, as victims may freeze in shock during the act. Nevertheless, you should try to defend yourself and clearly express your opposing will so that it is discernible to the other party.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Collect evidence<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">: Since there are usually no witnesses to the act in sexual criminal law, you should try to collect as much evidence as possible. In many cities, there are hospitals where you can be examined. This allows evidence to be secured after the act, even if you do not want to file a report right away. Collect everything you have: take photos of injuries, send a voice message to a friend about the incident, and try to remember the sequence of events as best you can.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Find witnesses to the act<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">: If there are witnesses, try to obtain their contact details. Witnesses are rare, as sexual offences usually occur behind closed doors. If there are any, ask for their names and, if applicable, mobile numbers or address details so they can be located for a possible trial.<\/span><\/span>\n<p> <\/p>\n<\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Get the help you need<\/b><span style=\"font-weight: 400;\"><span style=\"font-weight: 400;\">: Whether immediately after the act or some time later: if you notice that you are not coping with the burden, you should seek help.
