However, \u00a7 225 StGB only criminalizes such maltreatment that is directed against a specific group of people, namely <\/span><b>wards<\/b><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">The offense protects the <\/span><b>physical integrity<\/b><span style=\"font-weight: 400;\"> of a person.<\/span><\/p>\n<p> <\/p>\n<h3><strong>Who can be a ward?<\/strong><\/h3>\n<p><span style=\"font-weight: 400;\">Victims of maltreatment of wards can, according to the wording, only be wards. These are not exclusively, but particularly minors, i.e., <\/span><b>persons under 18 years of age<\/b><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In addition, other persons are also protected, namely those who are helpless due to <\/span><b>infirmity<\/b><span style=\"font-weight: 400;\"> or<\/span><b> illness<\/b><span style=\"font-weight: 400;\">. Thus, persons who are mentally\/physically ill or elderly can also be covered by the scope of application.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">Only individuals who have a special relationship with the person under their care can be considered perpetrators. According to Section 225 (1) of the German Criminal Code (StGB), persons under care are defined as those who are  under the age of 18 or who, due to illness or infirmity, are defenseless and <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">belong to the perpetrator&#8217;s <\/span><b>household<\/b><span style=\"font-weight: 400;\">,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">are under the <\/span><b>care<\/b><span style=\"font-weight: 400;\"> or <\/span><b>custody<\/b><span style=\"font-weight: 400;\"> of another person,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">have been placed in the <\/span><b>custody of a third party<\/b><span style=\"font-weight: 400;\"> by a person authorized to provide care, or<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">are subordinate within the framework of an <\/span><b>employment or service relationship<\/b><span style=\"font-weight: 400;\"> (e.g., apprentices). <\/span> <\/li>\n<\/ul>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Possible <\/span><b>caregivers<\/b><span style=\"font-weight: 400;\"> or supervisors therefore include, for example: <\/span> <\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Elderly care workers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Babysitters<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Guardians<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Parents<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Educators<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Nurses<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Teachers<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Youth welfare office employees<\/span><\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\">This list is not exhaustive.<\/span><\/p>\n<p><span style=\"font-weight: 400;\">This offense is particularly important for parents, as it has changed significantly in recent decades. In particular, the <\/span><b>parental right to chastise<\/b><span style=\"font-weight: 400;\"> was abolished as early as 2000. This means that physical chastisement by legal guardians can, in principle, also fall under the offense of \u00a7 225 StGB and have serious consequences. <\/span><b>Violence in upbringing<\/b><span style=\"font-weight: 400;\"> has thus been classified as a criminal offense by the legislator. <\/span> <\/p>\n<p> <\/p>\n<h3><span style=\"font-weight: 400;\"><strong>What is the difference between maltreatment and bodily harm?<\/strong><\/span><\/h3>\n<p><span style=\"font-weight: 400;\"><b>Maltreatment<\/b><span style=\"font-weight: 400;\"> always exists when the physical well-being or physical integrity of the other person has been violated. <\/span><\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">\u00a7 225 StGB states: <\/span><i><span style=\"font-weight: 400;\">&#8220;Whoever tortures or brutally maltreats a person (&#8230;) or harms their health through malicious neglect of their duty to care for them, shall be punished (&#8230;).&#8221;<\/span><\/i><span style=\"font-weight: 400;\"> According to this, <\/span><b>psychological maltreatment<\/b><span style=\"font-weight: 400;\"> (torture) also falls under the offense. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">At the same time, <\/span><b>brutality<\/b><span style=\"font-weight: 400;\"> is also punished. This is present when the caregiver acts with particular <\/span><b>callousness<\/b><span style=\"font-weight: 400;\"> and disregards the <\/span><b>suffering<\/b><span style=\"font-weight: 400;\"> of the ward. Furthermore, <\/span><b>maliciousness refers to neglect<\/b><span style=\"font-weight: 400;\"> due to particularly reprehensible, selfish motives. A mere overload of the supervisors therefore does not fall under this variant. <\/span> <\/p>\n<p> <\/p>\n<h2><span style=\"font-weight: 400;\"><strong>What penalty threatens upon conviction under \u00a7 225 StGB?<\/strong><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">The accusation of maltreatment of wards should in any case be <\/span><b>taken seriously<\/b><span style=\"font-weight: 400;\">, as a multi-year prison sentence is likely. The penalty here is a <\/span><b>prison sentence of 6 months <\/b><span style=\"font-weight: 400;\">to<\/span><b> 10 years<\/b><span style=\"font-weight: 400;\">. A monetary fine is not provided. Even the attempt is punishable and can be punished more leniently, but also equally. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In <\/span><b>particularly serious cases<\/b><span style=\"font-weight: 400;\">, the act is to be punished with a prison sentence <\/span><b>of not less than one year<\/b><span style=\"font-weight: 400;\">. Reasons for this include <\/span> <\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the danger of the ward&#8217;s death,  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the danger of serious health damage to the ward, or  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">significant damage to physical or mental development.  <\/span><\/li>\n<\/ul>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In such a qualification, the termination of proceedings is generally not possible, as it is legally considered a <\/span><b>felony<\/b><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Furthermore, maltreatment of wards can also fulfill other offenses, such as <\/span><b>aggravated bodily harm<\/b><span style=\"font-weight: 400;\"> (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__226.html\"><span style=\"font-weight: 400;\">\u00a7 226 StGB<\/span><\/a><span style=\"font-weight: 400;\">). Here, the <\/span><b>prison sentence is between 1 and 10 years<\/b><span style=\"font-weight: 400;\">. It is therefore also a felony.<\/span><\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Aggravated bodily harm exists if a serious consequence occurs:  <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the loss of sight, hearing, the ability to speak or reproduce,  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the loss of an important body part or if such a part is permanently unusable,  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">permanent disfigurement, falling into infirmity, paralysis, or mental illness or disability.  <\/span><\/li>\n<\/ul>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">If the maltreatment even causes the <\/span><b>death<\/b><span style=\"font-weight: 400;\"> of the victim, a <\/span><b>prison sentence of not less than 3 years<\/b><span style=\"font-weight: 400;\"> is to be imposed (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__227.html\"><span style=\"font-weight: 400;\">\u00a7 227 StGB<\/span><\/a><span style=\"font-weight: 400;\">, so-called bodily harm resulting in death). <\/span> <\/p>\n<p> <\/p>\n<h2><strong>How should I behave as an accused person?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\">Not only a conviction, but even the accusation can have serious consequences for one&#8217;s reputation and personal and professional environment. An accusation of this kind should therefore always be<\/span><b> taken seriously <\/b><span style=\"font-weight: 400;\">. Especially for professions with care duties, a <\/span><b>professional disqualification<\/b><span style=\"font-weight: 400;\"> can also be the consequence. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">At the same time, you should not go to the police over-motivated. Do not make a statement to the police without first having spoken to a lawyer. We understand your desire to explain the events from your perspective, but it is strongly advised against.
