This means that the offense of sexual coercion is essentially built upon the offense of sexual assault. To understand sexual coercion, we must therefore first look at sexual assault: <\/span><\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">A <\/span><b>sexual assault<\/b><span style=\"font-weight: 400;\"> occurs when sexual acts are performed on or by another person against their recognizable will. The individual elements of the offense for sexual assault are: <\/span> <\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">A<\/span><b> sexual act<\/b><span style=\"font-weight: 400;\"> on another person, or acts performed by the other person, or compelling the person to perform sexual acts on a third party,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>against the will<\/b><span style=\"font-weight: 400;\"> of the other person, <\/span> <\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">the will must be <\/span><b>recognizable<\/b><span style=\"font-weight: 400;\">, <\/span> <\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">with <\/span><b>intent<\/b><span style=\"font-weight: 400;\"> (= the knowledge and will to realize the elements of the offense).<\/span><\/li>\n<\/ul>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Following the criminal law reform, <\/span><b>coercion is no longer required<\/b><span style=\"font-weight: 400;\"> for sexual assault. Since 2016, this has been required for the separate offense of sexual coercion. Instead, the <\/span><b>opposing will<\/b><span style=\"font-weight: 400;\"> is decisive regarding sexual assault. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">This opposing will must be <\/span><b>recognizable<\/b><span style=\"font-weight: 400;\">. This means it must be apparent to the person acting that the other person is <\/span><b>averse<\/b><span style=\"font-weight: 400;\"> to the sexual acts. This will must be expressed either through a corresponding &#8220;no&#8221; (&#8220;no means no&#8221;) or through gestures, facial expressions, or other recognizable actions\u2014i.e., implicitly. However, there can also be a <\/span><b>exploitation of special circumstances<\/b><span style=\"font-weight: 400;\"> if the other person cannot articulate or express their will for certain reasons (e.g., date rape drugs, sleep, disabilities). <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Furthermore, sexual coercion exists if the <\/span><b>sexual assault occurs under threat of a sensitive evil<\/b><span style=\"font-weight: 400;\">. Possible coercive actions include: <\/span> <\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Threat of danger to life or limb,<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Use of force, or  <\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400;\">Exploitation of a situation in which the victim is defenseless.  <\/span><\/li>\n<\/ul>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Examples of this include restraining the victim, covering their mouth, physical assault, death threats, or threatening gestures. Blocking the apartment door or similar actions also constitute possible violence.  As a qualified offense, sexual coercion is generally punished more severely than sexual assault. <\/span><\/p>\n<p> <\/p>\n<h2><strong>What is the Difference from Rape?<\/strong><\/h2>\n<p><span style=\"font-weight: 400;\"><b>Rape<\/b><span style=\"font-weight: 400;\"> is also an aggravated form of sexual assault, but it has different requirements than sexual coercion. In the case of rape, there must additionally be the <\/span><b>performance of sexual intercourse<\/b><span style=\"font-weight: 400;\"> or a<\/span><b> similar sexual act<\/b><span style=\"font-weight: 400;\">. <\/span><\/span> <\/p>\n<p><span style=\"font-weight: 400;\">This is always the case when the body of the other person is <\/span><b>penetrated<\/b><span style=\"font-weight: 400;\">. It is not necessary for vaginal or anal intercourse to occur. Oral sex, as well as the insertion of other body parts (e.g., fingers) or an object, can also constitute rape from a legal perspective.<\/span><\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In the case of rape, the sentence is at least 2 years of imprisonment and can extend up to 15 years.  <\/span><\/p>\n<h2> <\/h2>\n<h2><span style=\"font-weight: 400;\"><strong>What is the Potential Penalty for Sexual Coercion?<\/strong><\/span><\/h2>\n<p><span style=\"font-weight: 400;\">A conviction for sexual coercion carries a prison sentence of <\/span><b>at least one year.<\/b><span style=\"font-weight: 400;\"> Since sexual coercion constitutes a felony (Verbrechen), a <\/span><b>provisional dismissal<\/b><span style=\"font-weight: 400;\"> of the proceedings is unlikely at first. Extreme caution must therefore be exercised with such an allegation. Furthermore, a <\/span><b>fine<\/b> <b>is excluded<\/b><span style=\"font-weight: 400;\">. <\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In addition to state sanctions, a social reaction is also to be expected.
