It regulates cases in which the assets of another person are damaged with the help of a <b>computer<\/b> or other technical <b>data processing<\/b>. The protective purpose of the norm, just like with fraud, is always the <b>assets<\/b> of another person.  <\/p>\n<p>Accordingly, a person is liable to punishment if, with the intent to obtain an unlawful pecuniary advantage for himself or a third party, he damages the assets of another by influencing the result of a <b>data processing operation<\/b> through incorrect program design, by using incorrect or incomplete data, by unauthorized use of data, or otherwise by unauthorized interference with the process.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-577acd8 elementor-widget elementor-widget-heading\" data-id=\"577acd8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Types of Computer Fraud<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d929b37 elementor-widget elementor-widget-text-editor\" data-id=\"d929b37\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><span style=\"font-weight: 400;\">Within the scope of computer fraud, there are various types of offenses for which a person can be held criminally liable. The legislator has explicitly listed these in Section 263a German Criminal Code. This is probably the most common variant of Section 263a German Criminal Code. <\/p>\n<p>Examples include the <b>use of other people&#8217;s accounts<\/b> on the internet or the use of another identity. Anyone who <b>steals an EC card<\/b> and uses it at an ATM is also liable to punishment. But <b>phishing emails<\/b> can also fall under this if they are used to obtain other people&#8217;s data.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dd50da0 elementor-widget elementor-widget-heading\" data-id=\"dd50da0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Influence through other interference with the data processing program's operation<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5ce414b elementor-widget elementor-widget-text-editor\" data-id=\"5ce414b\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>This offense serves as a catch-all provision and is intended to ensure that new case variants from everyday digital life are also covered by the law.
