Verbal harassment (e.g., catcalling) or physical proximity are generally not sufficient. These may, at most, fulfill the elements of sexual insult (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__185.html\"><span style=\"font-weight: 400;\">Section 185 StGB<\/span><\/a><span style=\"font-weight: 400;\">).<\/span> <\/p>\n<p><span style=\"font-weight: 400;\">It is irrelevant how the victim is touched, whether with an <\/span><b>object<\/b><span style=\"font-weight: 400;\"> or a <\/span><b>part of the body<\/b><span style=\"font-weight: 400;\"> (e.g., the hands).<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">A sexually determined manner exists whenever the touch is sexually motivated. This is primarily the case when <\/span><b>sexualized body parts<\/b><span style=\"font-weight: 400;\"> are touched, such as the genital area, female breasts, or buttocks. However, <\/span><b>kissing<\/b><span style=\"font-weight: 400;\"> or other touches perceived as sexual also fall under this. In contrast, <\/span><b>accidental touches<\/b><span style=\"font-weight: 400;\">, for example when passing by, are not included. However, the distinction is often difficult.<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">The <\/span><b>well-being<\/b><span style=\"font-weight: 400;\"> of the person touched is also decisive. This must be <\/span><b>significantly impaired<\/b><span style=\"font-weight: 400;\"> by the action. This is problematic primarily because it depends on the <\/span><b>subjective impression<\/b><span style=\"font-weight: 400;\"> of the person. This often leads to further difficulties in differentiation.<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">However, these difficulties in differentiation also offer good <\/span><b>defense opportunities<\/b><span style=\"font-weight: 400;\">, as the evidence is usually difficult, often involving &#8220;he-said, she-said&#8221; situations without further evidence (witnesses\/video recordings). This opens up possibilities for defense strategies that, in the best-case scenario, lead to the dismissal of the proceedings. To achieve this, an experienced <\/span><b>defense attorney<\/b><span style=\"font-weight: 400;\"> should be consulted at an early stage.<\/span> <\/p>\n<p> <\/p>\n<h2><span style=\"font-weight: 400;\">Sexual Harassment in the Workplace and the General Act on Equal Treatment <\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Sexual harassment frequently occurs in the <\/span><b>workplace<\/b><span style=\"font-weight: 400;\">. This is usually related to an existing power imbalance or a superior\/subordinate relationship. Women are particularly affected. Therefore, the <\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/agg\/\"><b>General Act on Equal Treatment<\/b><\/a><span style=\"font-weight: 400;\"> (AGG) defines sexual harassment itself; however, this has no effect on criminal sanctions, but only on labor law handling and its consequences.<\/span> <\/p>\n<p><span style=\"font-weight: 400;\"> <\/span><\/p>\n<p><span style=\"font-weight: 400;\">The AGG is significantly broader in scope: Unlike criminal law, it also sanctions suggestive remarks and verbal or non-verbal behavior. This includes in particular: <\/span><\/p>\n<ul>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Physical<\/b><span style=\"font-weight: 400;\">: As in criminal law, this includes touching and physical violence, but physical advances are also covered.<\/span> <\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Non-verbal<\/b><span style=\"font-weight: 400;\">: This refers to, for example, exposure, messages, emails, pornographic images, suggestive looks, or whistling.<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><b>Verbal<\/b><span style=\"font-weight: 400;\">: Requests for sexual acts, inappropriate questions, jokes, sexual remarks, or &#8220;catcalling&#8221; are also covered by the AGG.<\/span> <\/li>\n<\/ul>\n<p><span style=\"font-weight: 400;\"> <\/span><\/p>\n<p><span style=\"font-weight: 400;\">According to <\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/agg\/__3.html\"><span style=\"font-weight: 400;\">Section 3 IV AGG<\/span><\/a><span style=\"font-weight: 400;\">, the sexual harassment must be <\/span><b>unwanted<\/b><span style=\"font-weight: 400;\"> by the victim and classified by them as sexual harassment. Furthermore, the <\/span><b>dignity<\/b><span style=\"font-weight: 400;\"> of the person affected must be violated. If an allegation of sexual harassment in the workplace arises, those affected must expect <\/span><b>labor law <\/b><span style=\"font-weight: 400;\">as well as <\/span><b>criminal consequences<\/b><span style=\"font-weight: 400;\">. Usually, the problems begin in the area of labor law and quickly transition into criminal proceedings. Do not hesitate to consult a defense attorney at an early stage.<\/span><\/p>\n<h3><span style=\"font-weight: 400;\">Differences from Sexual Assault <\/span><\/h3>\n<p><span style=\"font-weight: 400;\">For sexual assault (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__177.html\"><span style=\"font-weight: 400;\">Section 177 I StGB<\/span><\/a><span style=\"font-weight: 400;\">), mere touching is not sufficient. At least one <\/span><b>sexual act must be performed on or by the victim against their express will, or the victim must be induced to perform or tolerate sexual acts on or by a third party.<\/b><span style=\"font-weight: 400;\"> The threshold for sexual harassment is therefore reached much more quickly than that for sexual assault. The latter carries a prison sentence of 6 months to 5 years, and in the case of rape (<\/span><a href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__177.html\"><span style=\"font-weight: 400;\">Section 177 (6) StGB<\/span><\/a><span style=\"font-weight: 400;\">), not less than 2 years.<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In addition, a <\/span><b>threshold of significance<\/b><span style=\"font-weight: 400;\"> must be crossed. If an offense falls below this threshold\u2014i.e., it is not significant enough\u2014a sexual assault can also be prosecuted as <\/span><b>sexual harassment<\/b><span style=\"font-weight: 400;\">.<\/span> <\/p>\n<p> <\/p>\n<h2><span style=\"font-weight: 400;\">Sexual Harassment in the Workplace: What Penalties Apply? <\/span><\/h2>\n<p><span style=\"font-weight: 400;\">If a conviction occurs, one must expect a <\/span><b>prison sentence of up to 2 years or a fine<\/b><span style=\"font-weight: 400;\">. Generally, a fine can be expected. However, this can already have significant consequences, e.g., regarding immigration law, weapons law, trade law, and especially labor law.<\/span><\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">In <\/span><b>particularly serious cases<\/b><span style=\"font-weight: 400;\">, such as when committed by a group, the prison sentence is at least 3 months and up to 5 years.<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">The allegation is therefore often downplayed in society; however, it must be said that law enforcement authorities and the <\/span><b>courts<\/b><span style=\"font-weight: 400;\"> take the criminal offense seriously and prosecute it with the full force of the law. Depending on the commission of the act, a prison sentence may also be imminent.<\/span><\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">Particularly in the case of an act at the <\/span><b>workplace<\/b><span style=\"font-weight: 400;\">, civil and labor law consequences must also be expected. In case of doubt, those convicted face <\/span><b>termination of employment<\/b><span style=\"font-weight: 400;\">. Furthermore, victims can assert civil <\/span><b>claims for damages and compensation for pain and suffering<\/b><span style=\"font-weight: 400;\">. But even the allegation alone is enough to cause significant damage to <\/span><b>reputation<\/b><span style=\"font-weight: 400;\"> and one&#8217;s <\/span><b>social life<\/b><span style=\"font-weight: 400;\">.<\/span><\/p>\n<p> <\/p>\n<h2><span style=\"font-weight: 400;\">Defense Attorney: How Should the Accused Behave? <\/span><\/h2>\n<p><span style=\"font-weight: 400;\">Sexual harassment in the workplace should always be <\/span><b>taken seriously<\/b><span style=\"font-weight: 400;\">, even if, under certain circumstances, only internal measures have been taken so far. Do not admit guilt to colleagues or superiors here either, as they could later testify against you as <\/span><b>witnesses<\/b><span style=\"font-weight: 400;\">. A report to the police is still possible long after the act.<\/span> <\/p>\n<h2> <\/h2>\n<p><span style=\"font-weight: 400;\">If <\/span><b>investigations<\/b><span style=\"font-weight: 400;\"> occur, law enforcement authorities proceed with the full force of the law. Even in the case of a false accusation, you should not expect it to resolve itself. Experience shows that it precisely does not. Instead, you should take measures as quickly as possible and <\/span><b>consult a <\/b><b>defense attorney<\/b><span style=\"font-weight: 400;\">. Police officers have been trained for years to believe the alleged victims rather than protestations of innocence.
