This includes statements that involve a degrading, disparaging evaluation of the victim.  <\/li>\n<li><b>Sexual harassment and sexual assault<\/b> (<b><a title=\"\u00a7\u00a7 184i, 177 StGB\" href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__184i.html\" target=\"_blank\" rel=\"noopener\">\u00a7\u00a7 184i, 177 StGB<\/a><\/b>): If the behavior involves physical contact or immediate physical approach, this may be punishable as <a title=\"sexual harassment\" href=\"https:\/\/stirnweiss-brenner.de\/en\/sexual-harassment-what-does-it-mean\/\">sexual harassment<\/a> or sexual assault. However, the catcalling under discussion typically refers to behaviors without physical contact, which is why the sexual offenses in question do not apply. <\/li>\n<li><b>Coercion<\/b> (<b><a title=\"\u00a7 240 StGB\" href=\"https:\/\/www.gesetze-im-internet.de\/stgb\/__240.html\" target=\"_blank\" rel=\"noopener\">\u00a7 240 StGB<\/a><\/b>): If the perpetrator threatens with a serious harm or forces the victim to a specific reaction, <a title=\"Coercion\" href=\"https:\/\/stirnweiss-brenner.de\/en\/sexual-coercion-what-is-the-potential-penalty\/\">coercion<\/a> may be present.<\/li>\n<li><b>Stalking<\/b> (\u00a7 238 StGB): If catcalling involves particularly persistent attempts to establish contact with the victim and the conduct is likely to seriously impair their lifestyle, criminal liability for stalking may exist.<\/li>\n<\/ul>\n<p>Whether one of these <b>criminal offenses<\/b> is fulfilled depends on the precise circumstances of the individual case. The distinction between criminally relevant conduct and socially undesirable behavior can be difficult in individual cases. <\/p>\n<h3>What penalty is threatened for these offenses?<\/h3>\n<p>The penalties depend on the respective offense and the circumstances of the individual case. If a person is insulted through catcalling (\u00a7 185 StGB), a fine or imprisonment of up to two years is threatened. In more serious cases, such as when stalking (\u00a7 238 StGB) or coercion (\u00a7 240 StGB) is present, the imprisonment may be <b>up to three years<\/b>.  <\/p>\n<p>In addition to criminal consequences, <b>civil law consequences<\/b> are also possible.
