There is an initial suspicion (<strong>Anfangsverdacht<\/strong>) that justifies criminal prosecution (<a title=\"\u00a7 152 para. 2 StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__152.html\" target=\"_blank\" rel=\"noopener\">Section 152(2) StPO<\/a>). <\/p><p>Important:<br>A summons is <strong>not an attribution of guilt<\/strong>. At this point, it is still open whether the suspicion will be confirmed or the proceedings will be discontinued. <\/p><p>In our experience, many suspects are unaware that being classified as a suspect already has significant legal consequences. From this moment on, special procedural rights apply\u2014especially the <strong>right to remain silent<\/strong>. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f6fc140 elementor-widget elementor-widget-heading\" data-id=\"f6fc140\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Who may summon suspects: the police or the public prosecutor\u2019s office? <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bc81383 elementor-widget elementor-widget-text-editor\" data-id=\"bc81383\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tBoth the police and the public prosecutor\u2019s office are entitled to question suspects.\n<ul style=\"margin-top: 20px; margin-bottom: 20px;\">\n \t<li>The <strong>public prosecutor\u2019s office<\/strong> is in charge of the investigative proceedings (<a title=\"\u00a7 160 StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__160.html\" target=\"_blank\" rel=\"noopener\">Section 160 StPO<\/a>).<\/li>\n \t<li>The <strong>police<\/strong> act as investigators for the public prosecutor\u2019s office (<a title=\"Section 163 StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__163.html\" target=\"_blank\" rel=\"noopener\">Section 163 StPO<\/a>).<\/li>\n<\/ul>\nAt our firm in Stuttgart and Konstanz, we often observe that suspects underestimate the significance of police summonses. In fact, these are regularly issued on behalf of the public prosecutor\u2019s office and serve to <strong>gather evidence<\/strong>. \t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bd12ab2 elementor-widget elementor-widget-heading\" data-id=\"bd12ab2\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Does a suspect have to comply with a police summons? <\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fa9d518 elementor-widget elementor-widget-text-editor\" data-id=\"fa9d518\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>No. As a rule, suspects are not obliged to comply with a <strong>police summons<\/strong>. In this case, there is no obligation to appear (<a title=\"Section 163a(4) StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__163a.html\" target=\"_blank\" rel=\"noopener\">Section 163a(4) StPO<\/a>). This applies regardless of how urgent or binding the invitation is worded.  <\/p><p>The situation may be different with a <strong>summons<\/strong> issued by the <strong>public prosecutor\u2019s office<\/strong>. It may order personal appearance; failure to appear can be enforced by coercive measures (<a title=\"Section 161a(1) StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__161a.html\" target=\"_blank\" rel=\"noopener\">Section 161a(1) StPO<\/a>). <\/p><p><strong>However, it is important to note:<\/strong> Even with a summons from the public prosecutor\u2019s office, there is no obligation to make a statement. The right to remain silent applies without restriction (<a title=\"\u00a7 136 StPO\" href=\"https:\/\/www.gesetze-im-internet.de\/stpo\/__136.html\" target=\"_blank\" rel=\"noopener\">Section 136 StPO<\/a>). <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-8ef5979 elementor-widget elementor-widget-heading\" data-id=\"8ef5979\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Why should suspects remain silent when summoned?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-dac0cff elementor-widget elementor-widget-text-editor\" data-id=\"dac0cff\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tMany suspects assume that by making a statement they could contribute to a swift clarification. In practice, however, this often leads to a <strong>deterioration of the evidentiary situation<\/strong>. \n\nTypical risks of ill-considered statements include:\n<ul style=\"margin-top: 20px; margin-bottom: 20px;\">\n \t<li>unintentional self-incrimination<\/li>\n \t<li>contradictions with later evidence<\/li>\n \t<li>misunderstandings in the record<\/li>\n \t<li>limiting later defence strategies<\/li>\n<\/ul>\nAt our firm, we regularly observe that remaining silent creates the basis for having the <strong>proceedings<\/strong> <strong>discontinued<\/strong> at an early stage\u2014for example, due to lack of suspicion or because of minor guilt.\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t<div class=\"elementor-element elementor-element-5b7191b e-con-full e-flex e-con e-child\" data-id=\"5b7191b\" data-element_type=\"container\" data-e-type=\"container\" data-settings=\"{&quot;background_background&quot;:&quot;classic&quot;}\">\n\t\t\t\t<div class=\"elementor-element elementor-element-4396052 elementor-widget elementor-widget-heading\" data-id=\"4396052\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h3 class=\"elementor-heading-title elementor-size-default\">Does the right to remain silent apply to every summons? <\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-df1a4f8 elementor-widget elementor-widget-text-editor\" data-id=\"df1a4f8\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\tYes.
