admissible<\/strong>; then the competent authority decides whether it will be carried out.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-7867f6a elementor-widget elementor-widget-text-editor\" data-id=\"7867f6a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The legal basis is the <a title=\"Act on International Mutual Assistance in Criminal Matters (IRG)\" href=\"https:\/\/www.gesetze-im-internet.de\/irg\/\" target=\"_blank\" rel=\"noopener\">Act on International Mutual Assistance in Criminal Matters (IRG)<\/a>, supplemented by treaties under international law and, within the EU, by the rules on the European Arrest Warrant. The Office of the Public Prosecutor General prepares the proceedings and files the applications with the OLG. After an arrest, it proceeds in the following order:  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-82a69ca elementor-widget elementor-widget-text-editor\" data-id=\"82a69ca\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<ol><li>Provisional arrest based on an alert or a request.<\/li><li>Appearance before a judge at the nearest Local Court, no later than the day after the arrest.<\/li><li>Hearing regarding personal details, instruction on the right to remain silent, and inquiry regarding objections.<\/li><li>Ordering of extradition custody by written arrest warrant from the Higher Regional Court (OLG), usually due to a risk of flight.<\/li><li>Decision by the OLG on admissibility, followed by authorization and handover.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1174088 elementor-widget elementor-widget-text-editor\" data-id=\"1174088\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If the client is in extradition custody, the OLG reviews at least every two months whether the detention may continue. Execution can be suspended earlier against conditions, such as reporting requirements, surrender of the passport, or bail. This is exactly where we start with the first application.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-0f26be0 elementor-widget elementor-widget-text-editor\" data-id=\"0f26be0\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The German court generally does not examine whether the allegation from abroad is true. The defense therefore concentrates on the question of whether extradition is admissible at all. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-657c06d elementor-widget elementor-widget-heading\" data-id=\"657c06d\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Challenging extradition decisions<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1a45a58 elementor-widget elementor-widget-text-editor\" data-id=\"1a45a58\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The decision of the Higher Regional Court on the admissibility of an extradition is <strong>final and not subject to appeal<\/strong> under the IRG. All objections must therefore be submitted before the court decides. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-6b5f88c elementor-widget elementor-widget-text-editor\" data-id=\"6b5f88c\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>We examine every request for obstacles to extradition. These include: <\/strong><\/p><ul><li>lack of dual criminality, insofar as it is required for the respective extradition route<\/li><li>threat of political persecution<\/li><li>a threat of the death penalty without binding assurances from the requesting state<\/li><li>detention conditions that violate Art. 3 of the European Convention on Human Rights<\/li><li>statute of limitations or an act that has already been adjudicated<\/li><li>judgments in absentia without preserved defense rights<\/li><li>incomplete or contradictory extradition documents<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-663e5fd elementor-widget elementor-widget-text-editor\" data-id=\"663e5fd\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The requesting state often relies on assurances, for example regarding detention conditions or return transfer. Whether these promises are resilient and verifiable is the decisive point of contention in many proceedings. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d67f6e9 elementor-widget elementor-widget-text-editor\" data-id=\"d67f6e9\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>If the OLG has declared the extradition admissible, two main paths remain: an application for a new decision if new circumstances exist, and a constitutional complaint to the Federal Constitutional Court with an urgent application against the handover. Both paths have narrow requirements and must be taken before the handover. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d780eac elementor-widget elementor-widget-heading\" data-id=\"d780eac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">Taking action against European Arrest Warrants<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-61dcf81 elementor-widget elementor-widget-text-editor\" data-id=\"61dcf81\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The European Arrest Warrant obliges EU states to quickly hand over wanted persons. However, it leaves room for objections that must be raised early. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-1f095e5 elementor-widget elementor-widget-text-editor\" data-id=\"1f095e5\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>Fixed thresholds apply for the issuance:<\/strong><\/p><ul><li>for criminal prosecution: a custodial sentence with a maximum of at least twelve months is threatened in the issuing state<\/li><li>for enforcement of a sentence: a sentence of at least four months was imposed<\/li><li>for 32 groups of offenses, including fraud, money laundering, and drug trafficking, the examination of dual criminality is waived if a maximum sentence of at least three years is threatened there<\/li><\/ul>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-bf66010 elementor-widget elementor-widget-text-editor\" data-id=\"bf66010\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The deadlines are tight. A decision on the handover should be made no later than 60 days after the arrest; in the case of consent to simplified handover, within ten days after this declaration. request by a state, circulated via Interpol, to arrest a person for the purpose of extradition. <strong>It is not an international arrest warrant<\/strong>, as each member state decides for itself how to respond to it.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-cd2639e elementor-widget elementor-widget-text-editor\" data-id=\"cd2639e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>For those affected, this makes little difference. Anyone subject to an alert must expect to be arrested at any border control in the 196 member states, often for years. In addition, there is the <i>diffusion<\/i>: a state asks other states directly to conduct a search.  <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-ea2256e elementor-widget elementor-widget-text-editor\" data-id=\"ea2256e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Article 3 of the Interpol Constitution prohibits any activity of a political, military, religious, or racial character. Alerts against opposition figures violate this rule, as do alerts against journalists. The Interpol rules for Red Notices also exclude purely civil law disputes, such as those between business partners. Objections are decided by the independent Commission for the Control of INTERPOL&#8217;s Files (CCF).   <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9de5025 elementor-widget elementor-widget-text-editor\" data-id=\"9de5025\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>This is how we proceed:<\/strong><\/p><ol><li>Obtaining information as to whether an alert exists and what its content is, from the CCF and the Federal Criminal Police Office (BKA) as the national Interpol office.<\/li><li>Filing an application for correction or deletion, with evidence of procedural defects or political background.<\/li><li>Checking national and European follow-up alerts, as deletion at Interpol does not automatically remove them.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-f4a689f elementor-widget elementor-widget-text-editor\" data-id=\"f4a689f\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>An application to the CCF does not require a prior arrest. The reason is almost always a hit during border control, as the border police compare travelers with national and international search databases, both upon entry and exit. <\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-91799cc elementor-widget elementor-widget-text-editor\" data-id=\"91799cc\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p><strong>If you or a relative are affected:<\/strong><\/p><ol><li>Do not provide any information on the merits of the case; only information regarding your identity is mandatory.<\/li><li>Do not agree to <i>simplified extradition<\/i> without consulting a defense attorney, as this consent cannot be revoked under the IRG.<\/li><li>Demand a criminal defense attorney immediately and have relatives call the firm&#8217;s emergency number.<\/li><li>As a foreign national, demand that your own consulate be notified.<\/li><\/ol>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-3736b48 elementor-widget elementor-widget-text-editor\" data-id=\"3736b48\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The appearance before the local court judge takes place no later than the day after the arrest.
