Above all, the so-called <strong>principle of legality<\/strong> applies, according to which the public prosecutor\u2019s office and the police are not only entitled but also obliged to investigate any initial suspicion of a criminal offence (\u201csufficient factual indications\u201d) and, after completion of the investigations, to bring charges before the court if there is sufficient suspicion. In addition, the so-called <strong>principle of objectivity<\/strong> applies, meaning that not only the courts but also the public prosecutor\u2019s office and the police must be objective and neutral in their investigations and decisions and, unlike for example in US criminal proceedings, must not be partisan. Overall, not least, the <strong>presumption of innocence<\/strong> prevails, which is even enshrined in Article 6 of the European Convention on Human Rights (ECHR). This \u201cdefence counsel\u201d is the suspect\u2019s legal representative and, in <em>criminal<\/em> proceedings, is also called a \u201c<em>criminal<\/em> defence lawyer\u201d. As a rule, this is an admitted attorney who practises in the field of criminal law and is particularly experienced in this area. As an attorney, the criminal defence lawyer is, of course, also an \u201corgan of the administration of justice\u201d, but they advocate for the rights of the accused. This is primarily about protecting the accused. These are <strong>cases of so-called mandatory defence<\/strong>. These include, for example, cases where \u201cit is to be expected that the main hearing at first instance will take place before the Higher Regional Court, the Regional Court or the lay judges\u2019 court\u201d (Section 140(1) No. 1 StPO), or where the accused is charged with a <strong>serious offence (\u201cfelony\u201d)<\/strong> (Section 140(1) No. 2 StPO), or where the proceedings<strong> \u201cmay lead to a professional ban\u201d<\/strong> (Section 140(1) No. 3 StPO), or where the accused is brought before a judge for a decision on <strong>pre-trial detention<\/strong> (Section 140(1) No. 4 StPO), or simply cases where \u201cdue to the seriousness of the offence, the severity of the expected legal consequence, or the difficulty of the facts or the law, the participation of defence counsel appears necessary\u201d or \u201cit is apparent that the accused cannot defend themselves\u201d (Section 140(2) StPO).   <\/p>\n<p>Contrary to a widespread view, having court-appointed defence counsel does not mean that an accused person cannot afford privately retained defence counsel or cannot afford a good criminal defence lawyer. Rather, the court\u2019s appointment of defence counsel is primarily about ensuring that, in the case of serious allegations and complicated cases, the constitutional state provides for the accused. This <strong>official title<\/strong>, which may be awarded by the locally competent bar association, is granted only to those attorneys who <strong>can demonstrate \u201cspecial theoretical knowledge and special practical experience\u201d in the field of criminal law in accordance with Sections 2, 3, 5 and 13 of the Specialist Lawyers\u2019 Regulations (FAO)<\/strong>. Such knowledge and experience exist only if, in the specialist field of criminal law, they \u201csignificantly exceed the level\u201d that would normally be expected on the basis of legal training and experience in the legal profession (Section 2(2) FAO). The specialist knowledge of a Specialist Lawyer for Criminal Law must also cover the constitutional, European and human-rights aspects of criminal law (Section 2(2) and (3) FAO), and to demonstrate special practical experience, the Specialist Lawyer for Criminal Law must have handled at least 60 criminal law cases independently and have defended clients on at least 40 main hearing days in major proceedings before the Local Court as a lay judges\u2019 court, the Regional Court, the Higher Regional Court or the Federal Court of Justice (Section 5(1)(f) FAO). Precisely because suspects have this right from the moment they are treated as a suspect, the status of being a suspect can be advantageous. Suspects should be aware of this advantage and <strong>know and exercise their rights as suspects<\/strong>.  <\/p>\n<p>In particular, every suspect has the right not to incriminate themselves (<strong>nemo tenetur principle<\/strong>) and even\u2014unlike witnesses, who generally must testify\u2014the right to remain silent, without that silence being interpreted to the suspect\u2019s detriment (<strong>right to remain silent<\/strong>). And: suspects have the right to be professionally represented by an attorney as criminal defence counsel (<strong>right to counsel<\/strong>). <\/p>\n<p>The right to a fair trial is also enshrined and elaborated, for example, in <strong>Article 6 of the European Convention on Human Rights (ECHR)<\/strong>. Article 6 ECHR specifies the rights of suspects as follows: <\/p>\n<ul>\n<li>Right to a hearing before an independent and impartial tribunal established by law, in a fair trial, in public and within a reasonable time;<\/li>\n<li>Right to public pronouncement of the judgment;<\/li>\n<li>Right to be presumed innocent until proved guilty according to law (so-called presumption of innocence);<\/li>\n<li>Right to be informed promptly, in a language which they understand and in detail, of the nature and cause of the accusation against them;<\/li>\n<li>Right to have adequate time and facilities for the preparation of the defence;<\/li>\n<li>Right to defend themselves in person or through legal assistance of their own choosing or, if they have insufficient means to pay for legal assistance, to be given it free when the interests of justice so require;<\/li>\n<li>Right to examine or have examined witnesses against them and to obtain the attendance and examination of witnesses on their behalf under the same conditions as witnesses against them;<\/li>\n<li>Right to the free assistance of an interpreter if they cannot understand or speak the German language.<\/li>\n<\/ul>\n<p>Suspects must be <strong>informed of the essential rights of suspects<\/strong> by the prosecuting authorities and later, for example, by the criminal courts. This instruction itself serves to protect the suspect and is therefore a <strong>fundamental right of the suspect<\/strong>. Not infrequently, police officers on the scene in particular violate these duties to inform and question suspects like a witness despite various allegations, so that a suspect initially has a \u201cfalse sense of security\u201d. As a witness\u2014and all the more as a suspect\u2014you should therefore <strong>insist early on on consulting an attorney<\/strong>. If the prosecuting authorities refuse to allow an attorney to be consulted, you should have this recorded immediately.    <\/p>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1252\" class=\"elementor-tab-title\" data-tab=\"2\" role=\"button\" aria-controls=\"elementor-tab-content-1252\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-right\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus-square\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">\u201cRight to remain silent\u201d \u2013 Why is it better for a suspect to remain silent?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1252\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"2\" role=\"region\" aria-labelledby=\"elementor-tab-title-1252\"><p>Suspects in investigative proceedings have the <strong>right to remain silent<\/strong>. No one is obliged to incriminate themselves through a statement, and a suspect&#8217;s silence may not be interpreted to their disadvantage.  This right to remain silent as a suspect and to exercise it has <strong>clear practical procedural advantages<\/strong>. Consider the following: <\/p>\n<p>Especially in criminal proceedings, a suspect is confronted with the state\u2019s clear superiority and is often genuinely shocked by investigative measures taken by the prosecuting authorities. In such shock moments, <strong>careless remarks can quickly \u201cslip out\u201d<\/strong> (so-called spontaneous statements), and even <strong>seemingly considered statements<\/strong> can be disadvantageous from a procedural-strategic perspective. This should be avoided, because officers of the prosecuting authorities always make file notes and record every statement made by a suspect. These recorded statements then not infrequently determine the further course of the proceedings and can later be revised only with difficulty\u2014or not at all.   <\/p>\n<p>In short:<\/p>\n<ul>\n<li>Do not make spontaneous statements, and do not make seemingly considered statements either. In criminal proceedings, suspects often overestimate their ability to exonerate themselves without consulting an attorney who specialises in criminal law. <\/li>\n<li>Exercise your right to remain silent until you have consulted with a criminal defence lawyer.<\/li>\n<li>In a constitutional state, your silence does not make you suspicious and does not mean that you have something to hide. Nor does your silence obstruct the investigation. And your silence does not prolong the proceedings.  <\/li>\n<li>Anyone who remains silent is simply exercising their legitimate right and knows that they should consult an attorney who specialises in criminal law.<\/li>\n<li>Anyone who remains silent knows that, through their attorney, they should first obtain access to the investigation files before making any statement on the allegation and investigative measures.<\/li>\n<\/ul>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1253\" class=\"elementor-tab-title\" data-tab=\"3\" role=\"button\" aria-controls=\"elementor-tab-content-1253\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-right\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus-square\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">\u201cDetention\u201d, \u201carrest\u201d, \u201chouse search\u201d \u2013 How should suspects behave correctly?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1253\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"3\" role=\"region\" aria-labelledby=\"elementor-tab-title-1253\"><p>Detentions, arrests, house searches, seizures or other intrusive investigative measures by the prosecuting authorities are often a shock moment for those affected. Nevertheless, it is important to <strong>keep a \u201ccool head\u201d<\/strong> and <strong>not to \u201cfight tooth and nail\u201d<\/strong>. <\/p>\n<p>This is because, on the one hand, there is the criminal offence of \u201cresisting enforcement officers\u201d (Section 113 StGB), and officers of the prosecuting authorities may also file a complaint for insult or bodily harm. On the other hand, it is important to remember your <strong>rights as a suspect<\/strong>. <\/p>\n<p>You should therefore behave as follows:<\/p>\n<ul>\n<li>Remain calm and act objectively.<\/li>\n<li>Do not make spontaneous statements about the allegation; instead, exercise your right to remain silent.<\/li>\n<li>Contact an attorney who specialises in criminal law immediately, and ask the officers on site to wait for the attorney to arrive.<\/li>\n<\/ul>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-1254\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-1254\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-right\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus-square\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">Receiving an \u201cindictment\u201d \u2013 What does this mean for the accused?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-1254\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-1254\"><p>After completing the investigations, the public prosecutor\u2019s office must decide whether the investigation result\u2014i.e. the factual circumstances and evidence as well as their criminal-law assessment\u2014allows the conclusion that a criminal court would likely convict the accused. If the public prosecutor\u2019s office reaches this conclusion, i.e. believes that there is a so-called predominant likelihood of conviction, it speaks of a <strong>\u201csufficient suspicion\u201d<\/strong> and is obliged to bring charges before the competent criminal court. If the public prosecutor\u2019s office does not reach this conclusion, it has the opposite duty to discontinue the proceedings. This respective duty of the public prosecutor\u2019s office is part of the so-called principle of legality.   <\/p>\n<p>In the event of an indictment, this decision by the public prosecutor\u2019s office also means that it has decided against the various options for discontinuing the criminal proceedings, for example discontinuation subject to payment of a monetary condition, and against issuing a penal order.
